Why IRCC Rejects Temporary Residence Visa (TRV) Applications?

Why IRCC Rejects Temporary Residence Visa (TRV) Applications?

Immigrating to Canada, even for a short term, requires applicants to meet eligibility criteria. Immigration, Refugees and Citizenship Canada (IRCC) assesses every Temporary Resident Visa (TRV) application based on various factors to ensure that individuals comply with Canada’s immigration laws. Many applicants face rejection due to inadmissibility, misrepresentation, or failure to meet eligibility requirements.

Effective January 31, 2025, IRCC proposed new regulations to strengthen the integrity of Canadian borders and ensure that the intentions for obtaining a TRV are genuine.

Common Reasons for TRV Rejections

  • Lack of Strong Ties to Home Country: One of the most common reasons for TRV refusal is the applicant's inability to prove that they will leave Canada at the end of their authorized stay. Officers assess factors such as employment, family ties, property ownership, and financial stability in the applicant’s home country. If these ties are weak, the application is likely to be denied.
  • Insufficient Financial Proof: Applicants must demonstrate that they have enough funds to support their stay in Canada. This includes covering accommodation, food, travel, and any other expenses. If the applicant fails to provide sufficient proof of financial stability or if there is uncertainty about the source of funds, IRCC may reject the application.
  • Failure to Meet Eligibility Criteria: An applicant may be deemed ineligible for a TRV due to various factors, such as:
    • A previous visa overstay or history of violating immigration rules
    • Criminal background
    • Health concerns that could pose a risk to public safety or burden Canada's healthcare system
    • Misrepresentation or false information in the application
  • Purpose of Visit is Not Clear: It is one of the common reasons for rejection. For applicants applying for a TRV, it is a must to provide a well-documented and convincing reason for their visit. This includes, but is not limited to, an itinerary, invitation letters (if applicable), and details about planned activities. If the officer is not convinced about the legitimacy of the trip, the visa may be denied.

New Regulations by IRCC for TRV Cancellations

As of January 31, 2025, IRCC has updated Canada’s Immigration and Refugee Protection Regulations to enhance its ability to cancel temporary resident documents, including TRVs and Electronic Travel Authorizations (eTAs). These changes empower immigration and border officers to cancel TRVs under the following circumstances:

  • Change in Status or Circumstances: If an applicant’s situation changes, making them inadmissible (e.g., they provide false information, have a criminal record, or are deceased), their TRV may be canceled.
  • Doubt About Departure from Canada: If an officer is not convinced that a person will leave Canada by the end of their authorized stay, they can cancel the visa.
  • Lost, Stolen, or Destroyed Documents: A TRV may also be canceled if the document is lost, stolen, destroyed, or abandoned.

Additionally, officers can now cancel TRVs, eTAs, work permits, and study permits issued to individuals who:

  • Become permanent residents of Canada
  • Are deceased
  • Received the document due to an administrative error

These updated regulations, published in the Canada Gazette II, aim to enhance the integrity of Canada’s temporary residence programs and strengthen border security.

How to Increase Chances of Canada TRV Approval?

  • Provide strong evidence of ties to their home country (job, assets, family responsibilities).
  • Show sufficient funds with clear documentation of financial stability.
  • Ensure all information is accurate and truthful to avoid misrepresentation.
  • Submit a well-documented application, clearly stating the purpose of the visit with supporting documents.
  • Follow IRCC guidelines carefully and provide any additional documents requested.
