Foreign Workers to Study in Canada without Study Permits

In a bid to bolster Canada’s post-pandemic economic recovery and provide more avenues for skill enhancement, the Canadian government has unveiled a temporary public policy that grants foreign nationals with valid work permits the opportunity to study without the need for a study permit. This progressive move aims to support temporary foreign workers in upgrading their skills, credentials, or licensing, thereby enhancing their employability, particularly in higher-skilled and better-compensated roles. Additionally, the policy is anticipated to address shortages in crucial sectors like healthcare and potentially increase their eligibility for permanent residency programs.

The initiative, officially announced by The Honourable Sean Fraser, P.C., M.P., comes under section 25.2 of the Immigration and Refugee Protection Act and is set to take effect on June 27, 2023. The policy is set to remain in effect until June 27, 2026, although it can be revoked at any time.

Key Highlights of the Public Policy:

Eligibility Criteria

  • Foreign nationals must currently hold a valid work permit, with their application for the permit submitted on or before June 7, 2023, to qualify.
  • Alternatively, individuals who have applied to renew their work permits under section 201 of the Immigration and Refugee Protection Regulations by June 7, 2023, and are authorized to work according to paragraph 186(u) of the Regulations, are also eligible.

Exemptions Granted

  • Foreign nationals meeting the above criteria will be exempt from the Regulations stipulated in paragraphs 188(1) (a) to (d) of the Regulations. These paragraphs outline the typical requirements for studying in Canada without a study permit.

Duration of Exemption

The exemption will apply until either the work permit associated with the aforementioned applications expires, the work permit application is refused, or the public policy itself expires or is revoked, whichever comes first.

It is crucial to note that foreign nationals who benefit from this policy remain subject to all other pertinent eligibility and admissibility requirements not specifically exempted under this or other public policies.
